2. Scope of Services

• We provide an online store for sports-themed apparel and accessories.
• You confirm you have the legal right to use the Services and abide by all applicable laws.

3. Ownership & License

• All site content—text, graphics, code, logos (“Content”)—is © Sportyet or our licensors.
• You have a limited, non-exclusive, revocable license to view and print Content for personal, non-commercial use only.
• Any other use requires our prior written permission at [email protected].

4. Your Commitments to Us

By using the Services you represent that you will not:

• Violate laws or infringe others’ rights.
• Circumvent security or interfere with site operation.
• Upload malware or spam.
• Misuse our support channels.
• Harvest data via robots or scraping tools.

If you breach these commitments, we may suspend or terminate your access without notice.

5. User Contributions

• You retain ownership of anything you post (“Contributions”), but grant Sportyet a perpetual, royalty-free license to use, modify, and distribute them.
• You warrant that your Contributions are original, lawful, and non-confidential.
• We may remove any Contributions at our discretion.

6. Order Terms, Returns & Cancellations

• Cancellations: Free within 24 hours of purchase. After that, orders enter production and cannot be canceled.
• Returns: Non-sale items returnable within 180 days in original condition.
• Refunds: Issued within 2 business days of receiving an approved return.

7. Service Changes & Interruptions

We may modify, suspend, or discontinue the Services (or any part) at any time without liability. We cannot guarantee uninterrupted access and are not responsible for downtime or errors.

8. Governing Law & Dispute Resolution

• Law: Indiana law governs these Terms, without conflicts of law.
• Arbitration: Disputes (excluding IP or injunctive claims) will be settled by binding arbitration in Carmel, IN, under AAA rules. You waive class actions.

9. Corrections & Updates

We may correct errors or update information at any time without notice. We reserve the right to revise these Terms; the Last Updated date will reflect changes. Your continued use after updates constitutes acceptance.

10. Disclaimer & Liability Limits

• Disclaimer: Services are provided “AS IS.” We disclaim all warranties to the fullest extent permitted by law.
• Limitation: Our total liability is capped at the greater of $100 or the amount you paid in the last 12 months. We are not liable for consequential or punitive damages.

11. Indemnification

You agree to defend and indemnify Sportyet from any third-party claims arising out of your use of the Services or violation of these Terms.

12. Electronic Communications

By using the Services or emailing us, you consent to receive electronic notices and agree that such communications satisfy legal writing requirements.

13. Miscellaneous

• Entire Agreement: These Terms and our linked policies constitute the full agreement.
• No Waiver: Failure to enforce any right is not a waiver.
• Severability: Invalid provisions do not affect the rest of the Terms.
• Assignment: We may transfer our rights and obligations at any time.
